Terms of Service
These Terms govern use of Kintex AIS by your organisation and users. Please read them carefully before creating an account or accepting them during onboarding.

1. Parties and definitions
These Terms of Service (“Terms”) form an agreement between Kintex (“we”, “us”, “our”), provider of Kintex AIS (Kintex Asset Inspection Software) (“Kintex AIS”, the “Service”), and the organisation or individual that creates or uses an account (“Customer”, “you”).
“Organisation” means a company or workspace created in the Service. “Users” are people invited or registered under an Organisation (for example system administrators, managers, inspectors, and maintenance staff). “Customer Data” means data, content, files, and materials you or your Users submit to the Service, including asset records, inspection answers, issues, tasks, photos, certificates, layouts, and reports.
2. The Service
Kintex AIS is a business software platform for professional asset inspection and related workflows. Features may include (depending on your plan and configuration): organisation and site hierarchy; asset registers and QR labelling; guided inspections with severity rules; issues and tasks; photo attachments; racking layouts; fleet and certificate tracking; dashboards and reporting; web dashboard and mobile app access; and role-based team access.
We may improve, add, or change features. Material reductions of core functionality for a paid plan will be communicated where reasonably practicable. Pilot, trial, and free tiers may include limits (for example asset caps) published in the Service or agreed separately.
3. Accounts, organisations, and administrators
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your Organisation’s accounts.
The first administrator and subsequent system administrators control invites, roles, and access. You must ensure only authorised people have access and that leavers are removed or archived promptly.
Where pilot access requires an invite code or similar control, you must not share codes outside authorised participants.
4. Acceptable use
You and your Users must not:
- Use the Service unlawfully, or to store or process data you are not entitled to process
- Attempt to gain unauthorised access to other organisations’ data or to our systems
- Probe, scan, or stress the Service except with our prior written consent
- Upload malware, or content that is illegal, harassing, or infringes others’ rights
- Resell, sublicense, or provide the Service to third parties as a competing product without our agreement
- Circumvent plan limits, security controls, or authentication
5. Customer Data ownership and licence
As between you and us, you retain ownership of Customer Data. You grant us a worldwide, non-exclusive licence to host, process, transmit, display, and create technical copies of Customer Data solely to provide, secure, support, and improve the Service (including backups, debugging, and aggregated non-identifying analytics).
You represent that you have all rights and notices required to submit Customer Data (including photos or personal data of workers or third parties that may appear in inspections). You are the controller of personal data in Customer Data unless we agree otherwise in a separate data processing agreement.
6. Our intellectual property
The Service, software, UI, documentation, templates, branding, and related IP remain ours or our licensors’. Except for the right to use the Service under these Terms, no rights are granted. You must not reverse engineer the Service except where applicable law prohibits that restriction.
7. Confidentiality
Each party may receive confidential information of the other. The recipient must protect it with reasonable care and use it only for performing under these Terms, except where the information is public, independently developed, or required to be disclosed by law (with notice where lawful).
8. Availability, support, and offline use
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. Planned maintenance or force majeure may cause downtime.
Mobile offline capture (where offered) depends on device storage and later sync; you remain responsible for ensuring inspections are submitted when connectivity allows and for validating critical records.
Support channels and response times for pilot customers may be described separately; unless a written SLA is signed, support is on a commercially reasonable basis.
9. Pilot, trials, and billing
Pilot or trial access may be free of charge, time-limited, capacity-limited, or invite-only. We may end or change pilot terms with reasonable notice.
Paid plans, invoices, and payment providers (for example future card billing) will be described in the Service or a commercial order. Unless stated otherwise, fees are exclusive of applicable taxes. Failure to pay may result in suspension after notice.
Downgrades may be blocked if your Organisation exceeds the lower plan’s asset or feature limits.
10. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Kintex AIS supports inspection workflows; it does not replace professional engineering judgement, statutory inspections where a licensed person is required, or your own compliance processes.
11. Limitation of liability
Nothing in these Terms limits liability that cannot be limited under applicable law (including death or personal injury caused by negligence, or fraud).
Subject to that: (a) we are not liable for indirect, consequential, special, or lost profits/revenue/data damages; and (b) our aggregate liability arising out of the Service in any twelve-month period is limited to the greater of (i) fees you paid us for the Service in that period, or (ii) one hundred pounds sterling (£100) for free pilot use.
12. Suspension and termination
We may suspend or terminate access for material breach, unpaid fees, legal risk, or security threats, preferably with notice when safe to give. You may stop using the Service and request Organisation deletion subject to our retention obligations and technical feasibility.
On termination, your right to use the Service ends. We may retain backups for a limited period as described in the Privacy Policy. Export options, where available, should be used before cancellation.
13. Changes to the Terms
We may update these Terms by posting a revised version on this page with a new “Last updated” date. Material changes will be highlighted in-product or by email where practicable. Continued use after the effective date constitutes acceptance, except where applicable law requires explicit consent.
14. Governing law
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect IP or Customer Data security.
